Welcome to SoulMate AI. Please read these Terms of Service ("Terms") carefully before using our mobile application ("App"). By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Content & Safety Guidelines described herein. If you do not agree, please do not use the App.

2. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. We implement age verification during registration and reserve the right to terminate any account found to belong to a minor.

3. Description of Service

SoulMate AI provides an AI-powered companion chat experience. All characters in the App are artificial intelligence entities, not real people. The App uses large language model (LLM) technology to generate responses based on character profiles, conversation context, and AI memory data.

How It Works:

• All AI-generated messages are clearly identified as such within the App
• Your messages are processed by third-party AI service providers to generate responses (see our Privacy Policy for details)
• The App uses an AI memory system that creates conversation summaries and extracts user preferences to improve conversation quality over time
• SoulMate AI, as the developer, assumes full responsibility for all AI-generated content displayed to users

Important Disclaimers:

• The AI characters are entirely fictional. They do not have real emotions, consciousness, or the ability to form genuine relationships
• AI-generated content may be inaccurate, inappropriate, biased, or misleading
• AI responses should never be considered professional advice of any kind, including but not limited to: medical, legal, financial, psychological, or therapeutic advice
• We do not guarantee the availability, accuracy, or quality of AI-generated responses

4. Account Registration

You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

5. User Conduct

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Send content that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to bypass content filters or safety measures
• Attempt to make the AI generate prohibited content (see Section 6)
• Impersonate any person or entity
• Interfere with or disrupt the App or its servers
• Use automated systems or bots to access the App
• Reverse engineer or attempt to extract source code from the App
• Share your account with others or create multiple accounts
• Use the App to generate content that harms, exploits, or endangers minors in any way

6. Prohibited Content & AI Safety

The following types of content are strictly prohibited in the App, whether user-generated or AI-generated. We actively employ automated filtering and safety measures to prevent such content:

6.1 Prohibited Content Categories:

• Child Sexual Abuse Material (CSAM): Any content that exploits, abuses, or endangers children, including AI-generated content depicting minors in sexual or harmful situations
• Non-Consensual Intimate Content: Sexually explicit deepfakes or AI-generated intimate imagery of real individuals without their consent
• Violence & Threats: Content that promotes violence, terrorism, self-harm, or threatens the safety of individuals
• Harassment & Bullying: Content that targets individuals or groups for harassment, intimidation, or abuse
• Hate Speech: Content that promotes hatred or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Fraud & Deception: Content designed to deceive, scam, or manipulate users, including phishing attempts or misinformation
• Illegal Activities: Content that promotes or facilitates illegal activities, including drug trafficking, weapons dealing, or money laundering
• Self-Harm & Suicide: Content that encourages, promotes, or provides instructions for self-harm or suicide

6.2 AI Content Safety Measures:

We implement multiple layers of content safety to comply with Apple App Store Guidelines and Google Play Developer Policies:

• Real-Time Content Filtering: Automated filters detect and block harmful, abusive, or prohibited content before it reaches users
• AI Safety Prompts: System-level instructions that direct the AI to refuse generating prohibited content
• Content Review: Our moderation team reviews escalated reports and continuously improves our filtering systems
• Continuous Improvement: We use aggregated, anonymized user feedback and reports to improve our content filtering and moderation systems

7. Reporting Objectionable Content

We provide multiple channels for reporting inappropriate or harmful content, in compliance with Apple App Store Guideline 1.2 and Google Play's AI-Generated Content policy:

7.1 In-App Reporting:

• Long-press any AI message in the chat and select "Report" to flag inappropriate content directly within the App
• Use the "Report a Problem" option in the App's Settings menu
• All reports are logged and reviewed by our moderation team

7.2 Email Reporting:

• Send a report to support@soulmate-ai.com with details of the objectionable content

7.3 Our Response Commitment:

• We acknowledge all content reports within 24 hours
• Confirmed violations are addressed (content removed, filters updated) within 24 hours of confirmation
• We use reports and feedback to continuously improve our content filtering and AI safety systems
• Accounts that repeatedly generate or attempt to generate prohibited content may be suspended or terminated

8. Mental Health & Crisis Resources

SoulMate AI is an entertainment product and is not a substitute for professional mental health support. If you or someone you know is experiencing a mental health crisis:

• Emergency: Call your local emergency number (e.g., 911 in the US, 112 in the EU, 999 in the UK)
• US — Suicide & Crisis Lifeline: Call or text 988
• US — Crisis Text Line: Text HOME to 741741
• International Association for Suicide Prevention: Find a crisis center near you

Please seek help from qualified professionals for any medical, psychological, legal, or financial matters.

9. Subscription and Payment

Premium Features:

• The App offers optional premium subscriptions with enhanced features, including unlimited messages, exclusive AI characters, priority response times, and access to premium content
• Subscription prices are displayed in the App before purchase and may vary by region
• Prices are in local currency and include applicable taxes

Auto-Renewal:

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your Apple ID or Google Play account will be charged for renewal within 24 hours prior to the end of the current period
• The renewal charge will be at the same price as the original subscription unless we notify you of a price change

Cancellation:

• iOS: Go to Settings > [your name] > Subscriptions > SoulMate AI > Cancel Subscription
• Android: Go to Google Play Store > Menu > Subscriptions > SoulMate AI > Cancel
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods
• Deleting the app does NOT cancel your subscription

Free Trials:

• If offered, free trials automatically convert to paid subscriptions at the end of the trial period unless canceled at least 24 hours before the trial ends
• Any unused portion of a free trial will be forfeited when you purchase a subscription

Restore Purchases:

• You may restore previously purchased subscriptions using the "Restore Purchase" feature in the App

10. Intellectual Property

• The App, including its design, features, and content, is owned by SoulMate AI and protected by intellectual property laws
• AI-generated responses are provided for your personal use only
• You retain ownership of the messages you send, but grant us a license to process them for service delivery, AI response generation, and AI memory features

11. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim
• We are not responsible for the accuracy, appropriateness, or reliability of AI-generated content
• We are not liable for any decisions or actions you take based on AI-generated content

12. Account Termination and Deletion

Account Deletion by You: You may delete your account at any time through:

• The App: Go to Profile > Delete Account or Settings > Delete Account
• The Web: Visit our Account Deletion page

Upon deletion, all your personal data, conversations, AI memory data, profile photos, and custom characters will be permanently removed within 30 days. See our Privacy Policy for full details.

Termination by Us: We may suspend or terminate your account if you violate these Terms, including but not limited to: attempting to generate prohibited content, bypassing safety measures, or abusing the reporting system. Upon termination, your right to use the App ceases immediately.

13. End User License Agreement (EULA)

This section serves as the End User License Agreement for the SoulMate AI application.

• License Grant: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial use
• License Restrictions: You may not: (a) copy, modify, or distribute the App; (b) sublicense, lease, or rent the App to any third party; (c) reverse engineer, decompile, or disassemble the App; (d) remove or alter any proprietary notices or labels on the App
• Apple Users: For users who downloaded the App from the Apple App Store, this EULA is between you and SoulMate AI (not Apple). Apple has no obligation to furnish maintenance or support services for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App. Apple is a third-party beneficiary of this EULA and may enforce it against you
• Google Users: For users who downloaded the App from Google Play, this EULA is between you and SoulMate AI. Google is not responsible for the App or its content
• Termination: This license is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with any of its terms

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, providing an in-app notification. Your continued use of the App after changes constitutes acceptance of the modified Terms.

15. Dispute Resolution

Any dispute arising from or relating to these Terms or your use of the App shall be resolved as follows:

• Informal Resolution: Before filing any formal claim, you agree to first contact us at support@soulmate-ai.com and attempt to resolve the dispute informally for at least 30 days
• Governing Law: These Terms shall be governed by and construed in accordance with the laws applicable in your jurisdiction of residence, without regard to conflict of law principles
• Jurisdiction: Any legal proceedings shall be conducted in the courts of competent jurisdiction in your area of residence, unless otherwise required by applicable consumer protection laws
